Existing situation and proposed measures to manage foreign direct investment enterprises in Binh Dinh province

Binh Dinh province has attracted 87 foreign direct investment (FDI) enterprises, with a total registered capital of about USD 1.02 billion (38 enterprises have investment projects in Nhon Hoi economic zone and industrial parks, with a total registered capital of about USD 743 million and 49 enterprises have projects outside Nhon Hoi Economic Zone and industrial parks, with a total amount of about USD 272 million) of the foreign investors from 21 countries and territories such as Japan, Republic of Korea, Thailand, Germany, China, the United States, France, Singapore, etc. Most of the enterprises are small and medium-sized ones, with an average capital of about USD 12 million per enterprise. The biggest one is Viet My hotel and tourism Co.,Ltd (USA) with the total registered investment capital of USD 250 million (not yet in operation) and the smallest ones are V&J Human Resource Co., Ltd (Japan) and V&J Human Resource School Co., Ltd (Japan), with the total registered capital of USD 30 thousand each.

The management of the FDI enterprises’ production and business activities depends on the location where its project is located. For the enterprises with their projects located in the economic zone and the industrial parks, the Provincial Economic Zone Administration in coordination with the Provincial Public Security, the Department of Foreign Affairs and the relevant agencies recommends the Provincial People's Committee to fully manage all aspects of the enterprise’s operation from introduction of location, investment policy, investment licensing, project management, production and business activities, etc. to advice on the termination of the enterprise's operation.

For those with their projects outside the economic zone and the industrial parks, the Department of Planning and Investment in coordination with the Provincial Public Security, the Department of Foreign Affairs, the Department of Labor - Invalids and Social Affairs and the related agencies advises the Provincial People's Committee to do so. Although the management tasks are clearly assigned, for various reasons such as the activities of the FDI enterprises quite diverse, the payroll of state management agencies limited, the personnels assigned in charge not fixed, the conditions and facilities for management not adequate, the coordination of some enterprises sometimes not timely and adequate, etc, the state management of the FDI enterprises’ operation in the province has not yet been satisfactory to some extent. This resulted in some limitations and inadequacies, especially when the enterprises faced problems in terms of raw materials, labour supply, markets, technical barriers, accusations of dumping or exemptions or reductions in investment and business incentives, etc., they do not know where to contact to be consulted, but they tried to handle the problems by themselves. Therefore, their production and business abilities were to some extent reduced, affecting the investment attraction environment of the province.

In such a situation, it is required to constantly innovate the state management in the way of arranging some agencies that are competent, specialized and good at the markets and the international laws to help the FDI enterprises effectively carry out their production and business activities, contributing more and more to the socio-economic development of the province.

To improve the operation quality of the FDI enterprises in the province, the proposed measures to be taken in the coming time are as follows:

- The departments, sectors and localities in the province continue to promote propaganda and provide guidance of the provisions of the law in a timely manner for the enterprises to quickly access the new guidelines and policies of the Party and the State for their development goals and strategies.

- The Department of Planning and Investment and the Provincial Economic Zone Administration pay attention to promoting investment attraction, solving or coordinating with the relevant agencies to propose the competent authorities to promptly and legally settle the issues related to land, location, site clearance, investment licensing, etc. for the FDI projects, especially the large-scale ones with high-tech products, huge labor forces, abilities to create the driving force for the socio-economic development of the province.

- The Departments of: Industry and Trade, Labor - Invalids and Social Affairs, Natural Resources and Environment, etc. strengthen their state management, regularly monitor, provide guidance and promptly remove the difficulties and obstacles in the FDI enterproses’ operation, especially the supply of raw materials, consumption of products; expansion of the production scale and location, expansion of the raw material areas, employment of workers, labor disputes, etc. to help them quickly get stabilized and go into effective production.

- It is needed to improve the management measures, especially improving the administrative procedures, shortening the time for appraisal of investment policies, environmental impact assessment, design appraisal and approval, issuance of work permits, etc. and encourage the enterprises to effectively operate and improve their production and processing capacity and to expand the domestic and foreign markets.

- Periodically hold dialogues with the FDI enterprises in the province to listen and remove their difficulties and obstacles, praise the ones with effective production and business activities, greatly contributing to the local community.

- The relevant departments and sectors strengthen specialized inspection and examination of the enterprises with signs of violations in production, business and environmental protection activities and in execution of the regimes and policies for their employees to help them operate in accordance with the law.

- The Department of Foreign Affairs acts as the focal point, sums up the operation situation, problems and recommendations of the FDI enterprises, inclusive of the operation situation of the province’s enterprises investing and doing business abroad; the outstanding and unresolved issues of the relevant functional agencies and the foreign organizations and individuals’ violations; periodically reports and proposes the Provincial People's Committee to settle.
